1. Creating a user account

To create a user account, you must be 18 years old and above and consent to provide the Ministère du Tourisme with the following information:

• a valid email address;
• a username;
• a password;
• your answer to a secret question selected from several options, which will allow you to get a new password if necessary;
• your location (country and state or province if applicable).

This information is mandatory and allows the Ministère du Tourisme to create, manage and protect your account. Providing your location is necessary for statistical purposes and allows the Ministère du Tourisme to evaluate the number of foreign visitors who have an interest in Québec and use the Destination Québec site.

With regard to your account, you agree to:

• keep your information up-to-date;
• keep your password and answer to your question secret;
• notify the Ministère du Tourisme of any unauthorized use immediately;
• log out at the end of each session by clicking on the "Quit" link located on each page.

2. Privacy policy

The Ministère du Tourisme is committed to safeguarding your privacy and the personal information published on the Destination Québec Website. In this connection, please refer to the Privacy policy section.

3. Posting photos, videos, stories and comments

All content, including photos, videos, stories or comments posted on the Destination Québec site must exclusively focus on travel experience in Québec, must be true, and must be written in French or English.

You are responsible for the content that you publish on the site. You must have all intellectual property rights and necessary consent from persons in your photos or videos prior to posting them on the site.

You may delete any content that you have published on the site at any time by clicking on the recycle bin icon located underneath any content in your account profile. The content will be permanently deleted with no option for recovery. However, the deletion of content rebroadcast on the official tourist site of the government of Québec might take 24 hours before becoming effective.

4. Filtering

Your user name, avatar and any content, including photos, videos, stories and comments as well as any changes thereto are filtered by the Ministère du Tourisme prior to posting on the Destination Québec site.

The Ministère du Tourisme reserves the right to delete inappropriate content, including pornographic, racist or violent content or any content that has no connection with the site objectives at any time.

The Ministère du Tourisme takes all reasonable measures to filter content within two (2) business days.

5. Filing a report with the Ministère du tourisme

If you notice that content published on the site is inappropriate or does not comply with the Terms and Conditions, please file a report with the Ministère du Tourisme by clicking on the "Report" link located underneath any content and select the "Inappropriate content" option.

To report copyright infringement or breach of privacy, please contact the Ministère du Tourisme by clicking on the "Report" link located underneath any content and select the "Copyright infringement" or "Breach of privacy" option. Complete the form, print and sign it and mail it to the Ministère du Tourisme at the address on the form.

The Ministère du Tourisme reserves the right to delete any content, including an avatar, that has been reported.

6. Site and content hosting

The Destination Québec site and content are hosted by the Ministère du Tourisme and other partners where applicable.

7. Copyright licence

By publishing content, including photos, videos, stories or comments on the Destination Québec site, you hereby grant the Ministère du Tourisme, free of charge, a non-exclusive and non-transferable worldwide licence authorizing the reproduction and communication to the public by telecommunication of the content for use on the site as well as on the official tourist site of the government of Québec. The copyright licence terminates with the deletion of the said content or, for content rebroadcast on the official tourist site of the government of Québec, 24 hours later.

Moreover, despite the non-transferrable nature of the licence, the content that you publish on the site may require a sub-licence for reproduction and communication to the public by telecommunication to enable the Ministère du Tourisme to use partners where necessary and allow them to host the content under the responsibility of the Ministère du Tourisme.

You guarantee the Ministère du Tourisme and the government of Québec that you have all the necessary rights to publish the content on the site and grant this licence to the Ministère du Tourisme. You also guarantee the Ministère du Tourisme and the government of Québec that all content published does not violate other people's rights or the Terms and Conditions.

8. Deleting a user account

You can delete your user account at any time by selecting the "Delete my account" option located in your account profile.

The Ministère du Tourisme reserves the right to delete user accounts that violate the Terms and Conditions. It may also delete accounts for administrative or security reasons or if the accounts are inactive.

Deleting a user account, whether done by you or the Ministère du Tourisme, is final with no possibility of recovery. The deletion leads to the automatic removal of all content published by the account user, and where applicable, of elements associated with the account, including other users' votes and comments.

9. Final provisions

The Ministère du Tourisme reserves the right to temporarily suspend or terminate the operation of the Destination Québec site in whole or in part.

The site is not a service for hosting or storing your personal photos, videos or stories. You must therefore store your original files, including photos and videos, on another archival format as they cannot be retrieved or downloaded from the site.

The Ministère du Tourisme and the government of Québec are not liable for any damage you may sustain from the use or non-availability of the site.

The Ministère du Tourisme reserves the right to modify the Terms and Conditions at any time.

The site and site use will be governed in accordance with the laws of the province of Québec. All disputes in connection with the site shall be submitted to the exclusive jurisdiction of the courts of the province of Québec.
